1. Transfer for family unit reunification

The first scenario established by law (Art. 2, Law 470/1988) concerns transfers based on the presence of members of your family unit registered in the AIRE or the Registry of the Resident Population (APR) of the destination Municipality. It is important to emphasize that the concept of “family unit” in this context is very specific and restrictive, following the social security criteria as provided by law (D.L. 69/1988). It exclusively includes the spouse (if they are not legally separated) and minor children (or adult children, but only if they are permanently unfit for work). In special cases, it may include orphaned siblings, grandchildren, nephews, or nieces who are minors (or unfit for work), provided they do not receive a survivor’s pension. The absence of family members falling into these precise categories is considered grounds for the denial of the transfer.

2. Registration in the electoral rolls of the Italian Municipality of birth

The second scenario in which a transfer from one Municipality’s AIRE to another is possible is related to the exercise of voting rights. According to the provisions of Law 15/1992 and T.U. 223/1967, every citizen residing abroad has the right to request, at any time, registration in the electoral rolls of their Municipality of birth. A citizen exercising this right must submit a request to the Municipality of birth through the competent Italian Consulate. Should the Mayor of the Municipality of birth grant this request, the voter shall be registered in the AIRE of that same Municipality.

If the Municipality accepts the request, it will proceed with the registration and inform the Consulate, the citizen, and the previous AIRE Municipality.
